Definition of terms used in the privacy policy:

"Personal data": any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person", in accordance with the French Data Protection Act of January 6, 1978.


"Service": the Service and all of its content. "Publisher" or "We": BioDraine, a legal or natural person responsible for the editing and content of the Service.


"User" or "You": the Internet user visiting and using the Service.

 

Article 1 - Introduction and role of the privacy protection policy

The purpose of this charter is to inform you of the Service's commitments regarding the respect of your privacy and the protection of your personal data, collected and processed during your use of the Service. It is important that you read this privacy policy to understand why and how we use your data. By registering for the service, you agree to provide us with truthful information about yourself. Providing false information is contrary to the general terms and conditions on the Service. Article 2 - Data collected on the Site

The data collected and subsequently processed by the Service are those that you voluntarily transmit to us by filling out the various forms on the Service. For certain content-related operations, you may be required to transmit data about yourself to third-party partners via their own services, particularly when making payments. We will not have access to this data, as its collection and processing are governed by the specific conditions of these third parties. We invite you to consult their conditions before transmitting your data in this context.

Your IP address (identification number assigned to your computer on the Internet) is automatically collected. You are informed that the Service may implement an automatic tracking process (Cookie), which you can prevent by changing the relevant settings in your Internet browser, as explained in the general terms and conditions of this Service.

In order to provide better content and services, the Service https://biodraine.fr/ uses Google Analytics. Google Analytics does not track your browsing habits on third-party services.

The information about you that Google Analytics has access to does not contain any personal data about you. We do not collect so-called "sensitive" data.

The contact details of Users of the Service who have registered will be kept, in compliance with the provisions of the French Data Protection Act of January 6, 1978.

The collection of Users' personal data by the Publisher does not require a declaration to the French personal data protection authority (the Commission Nationale de l'Informatique et des Libertés - CNIL).

Article 3 - Identity of the Data Controller
The Data Controller is the company BioDraine, whose registered office is located at:

Article 4 - Purpose of collected Data

The Data identified as mandatory in the Service's forms are necessary to benefit from the corresponding functionalities of the Service, and more specifically from operations related to the content offered therein.

The Service may collect and process its Users' Data:

  • In order to provide you with the information or services you have subscribed to, including: sending newsletters, retargeting on Facebook, Snapchat, Google, etc.
  • In order to collect information allowing us to improve our Service, our products and our functionalities (including via the use of cookies).
  • In order to contact you regarding: promotional offers, new products, contests, brand news, advice.

Article 5 - Recipients and use of collected Data

The data we collect is processed in the context of operations related to the content of the Service. You may receive electronic mail (emails) from our Service, particularly as part of newsletters to which you have subscribed. Only BioDraine is the recipient of your personal information. This information is never transmitted to third parties, except to subcontractors used by BioDraine. Neither BioDraine nor its subcontractors market the personal data of visitors and users of its Service. Your personal data may be shared with the parties mentioned below for the purposes defined in this privacy policy. We require all third parties to guarantee the security of your personal data and to process it in accordance with the law. We do not authorize our third-party service providers to use your data.

SMS marketing and notifications:
By entering your phone number at checkout and initiating a purchase, subscribing via our subscription form, or using a keyword, you agree that we may send you SMS notifications (for your order, including abandoned cart reminders) as well as SMS marketing offers. The number of SMS will be limited to three per month. You acknowledge that your consent is not a condition of purchase.

If you wish to unsubscribe and no longer receive SMS or notifications, reply STOP to any mobile message sent by us or use the unsubscribe link included in one of our messages. You understand and agree that other methods of opting out, such as using alternative words or requests, will not be considered valid means of unsubscribing. Message and data charges may apply.

Consent to automated SMS marketing:

Article 6 - Legal basis governing data processing

In accordance with the General Data Protection Regulation (GDPR), BioDraine processes personal data only in the following situations:

  • With your consent;
  • Where there is a contractual obligation (a contract between BioDraine and you);
  • To comply with a legal obligation (under EU or national law).

Article 7 - Data security

You are informed that your Data may be disclosed in accordance with a law, regulation, or decision of a competent regulatory or judicial authority, or if it is necessary for the Publisher to protect its rights and interests.

We have put in place appropriate security measures to prevent accidental loss, use, alteration, disclosure, or unauthorized access to your personal data. In addition, access to your personal data is subject to a defined and documented security procedure.

Article 8 - Data retention period

The Data is hosted by the Service's host, whose contact details are provided in the legal notice of the Service, and is kept for the period strictly necessary for the purposes mentioned above, not exceeding 24 months. Beyond this period, it will be kept for purely statistical purposes and will not be subject to any exploitation whatsoever.

Article 9 - Authorized service providers and transfer to a third country outside the European Union

BioDraine informs you that it uses authorized service providers to facilitate the collection and processing of the data you have provided to us. These service providers may be located outside the European Union and have access to the data collected via the various forms on the Service.

BioDraine has previously ensured that its service providers implement adequate guarantees and comply with strict conditions regarding confidentiality, use, and data protection. In particular, special attention has been paid to the existence of a legal basis for any data transfer to a third country. 

Article 10 - Data Protection Rights

In accordance with data protection legislation, you have the following rights that you can exercise, as indicated in Article 1 of this privacy policy, by sending an email to contact@biodraine.fr

  • The right to information: we have an obligation to inform you of how we use your personal data (as described in this privacy policy).

  • The right of access: this is your right to request access to your data in order to receive a copy of the personal data we hold. However, due to the security and confidentiality obligation in the processing of personal data incumbent on BioDraine, you are informed that your request will be processed subject to providing proof of your identity, including by sending a copy or scan of your valid identity card.

However, the exercise of this right is only possible in one of the following two situations: when the exercise of this right is based on legitimate grounds or when the exercise of this right aims to prevent the collected data from being used for commercial prospecting purposes.

Contact us if you wish to exercise any of the rights described above by sending an email to contact@biodraine.fr You will not have to pay a fee to access your personal data (or to exercise any other right). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. In this case, we may also refuse to respond to your request.

BioDraine will have the right, if applicable, to object to requests that are manifestly abusive due to their systematic, repetitive, or numerous nature. We may ask you for specific information to confirm your identity and ensure your right to access your personal data (or to exercise any other right). This is a security measure to ensure that this personal data is not disclosed to an unauthorized person. We may also contact you to obtain more information about your request, in order to provide you with a faster response. We try to respond to all legitimate requests within one month. This one-month period may be exceeded if your request is particularly complex or if you have made several requests. In this case, we will inform you and keep you updated.

Article 11 - Complaint to the Data Protection Authority

If you believe that BioDraine is not fulfilling its obligations regarding your Personal Information, you can submit a complaint or request to the competent authority. In France, the competent authority is the CNIL, to which you can submit a request electronically at the following address: https://www.cnil.fr/en/complaints/internet.

Article 12 - Cookie Policy

When you first use the Service https://biodraine.fr/, you are informed by a banner that information relating to your browsing may be recorded in alphanumeric files called "cookies". Our cookie use policy allows you to better understand the provisions we implement regarding browsing on our Service.
